These Terms and Conditions (“Agreement”) govern the sale of travel services provided by Demaco d.o.o. (“Intours DMC”, “the Agency,” “we,” “our,” or “us”) to the client (“the Client,” “you”). By purchasing an excursion or travel package through our website and making a payment via Stripe, the Client agrees to comply with and be bound by these terms.
1. General Information
1.1 The Agency, Demaco d.o.o., is a travel agency licensed to organize and sell travel arrangements and excursions in Croatia.
1.2 The excursion or travel package is considered confirmed once the full payment has been processed and received.
2. Payment Terms
2.1 All payments for excursions must be made via credit card through the Stripe payment gateway, unless agreed otherwise with the Agency.
2.2 The price of the excursion includes all taxes, levies, and fees, and the price advertised on the website represents the final price for the Client.
3. Cancellation by the Agency
3.1 The Agency reserves the right to cancel an excursion for safety reasons if external factors are deemed to jeopardize the safety of participants or the organizer.
3.2 In case of cancellation by the Agency, the Client will receive a full refund of the amount paid within 15 working days from the date of cancellation.
3.3 The Agency reserves the right to cancel an excursion if the minimum number of participants is not reached. The minimum participant capacities are defined as follows:
Old Town Walking Tour with City Walls – Minimum 8 persons
Game of Thrones Tour with Lokrum Island – Minimum 8 persons
Kayaking Around the City Walls – Minimum 12 persons
Konavle Countryside Tour – Minimum 14 persons
Peljesac Peninsula Tour – Minimum 14 persons
Cooking Class in the Countryside – Minimum 10 persons
Gourmet Tour – Minimum 8 persons
Elaphiti Islands by Speedboat – Minimum 12 persons
3.4. The Agency reserves the right to adjust the excursion schedule, itinerary, or meeting times due to operational reasons, weather conditions, or other circumstances beyond its control. Any such changes will be communicated to the Client as soon as reasonably possible.
4. Cancellation by the Participant
4.1 In the event that the Client wishes to cancel their booking, the following cancellation policy will apply:
Cancellations are free up to 21 days before the tour. Cancellations made within 21 days of the tour will be charged in full.
4.2 Cancellations must be made in writing (email or other forms of written communication) to the Agency in order to be processed according to the terms above.
4.3. If the Client fails to appear at the designated meeting point at the specified time, the booking will be considered a no-show, and no refund will be provided.
5. Personal Belongings
5.1 The Agency shall not be responsible for any loss, theft, or damage to personal belongings of the Client during the excursion unless caused by gross negligence by the Agency’s or its Suppliers’ staff
6. Insurance
6.1 The Agency guarantees that it complies with Croatian legal requirements regarding participant insurance for travel arrangements. The necessary insurance coverage is included in the excursion price.
7. Third-Party Suppliers
7.1 The Agency may use third-party suppliers (“Suppliers”) for organizing and executing certain elements of the travel arrangements, such as transportation, accommodation, or guided tours. While we carefully select our partners, the Agency cannot be held responsible for acts or omissions of such suppliers beyond its reasonable control.
8. Liability and Force Majeure
8.1 The Agency shall not be liable for any damage, losses, or injuries that occur during the excursion unless caused directly by the Agency’s negligence or failure to meet its obligations as an organizer.
8.2. Participants are responsible for ensuring they are in suitable physical condition for the selected excursion. The Agency reserves the right to refuse participation to any person whose condition may endanger themselves or others.
8.3 The Agency is not liable for any delay, failure, or disruption in the excursion due to circumstances beyond its control, including but not limited to weather conditions, natural disasters, strikes, war, or other force majeure events. In such cases, the Agency reserves the right to amend, suspend, or cancel the excursion without liability.
9. Confirmation of Booking
9.1 The booking of an excursion is confirmed when the Client completes the payment process in full. The Agency will issue a confirmation receipt via email upon successful payment.
10. Changes to the Terms and Conditions
10.1 The Agency reserves the right to amend or update these Terms and Conditions at any time. The most current version of the Terms and Conditions will be posted on the website, and the changes will apply to any bookings made after the date of the amendment.
11. Governing Law and Dispute Resolution
11.1 These Terms and Conditions are governed by Croatian law. Any disputes arising out of or in connection with this Agreement will be resolved by the competent courts in Croatia.
12. Personal data protection
Personal data collected during the booking process will be processed in accordance with our Privacy Policy available on this website.
